Alaska Housing Advisory Luncheon

AHFC’s Mortgage and Governmental Relations and Public Affairs departments are working together to develop Operational and PR plans to address AHFC’s mortgage products statewide. Great News!

 


On Monday, December 5th, Deputy Commissioner Curtis Thayer told the Legislature’s Budget & Audit Committee that the real estate license increase would only be $100. This would make the two-year license fee $375 instead of the proposed $685.

With the 2,450 licensees in the State, this is a $759,500 savings, $310 per licensee.

According to Don Haberger, the Director of the Division of Corporations, Business & Professional Licensing, ”the change was based on the robust public comment on the fee increase proposal as it came out in draft stage.”

The Alaska Association of REALTORS would like to personally thank everyone who wrote letters to their Senators and Representatives and testified at the House Community and Regional Affairs Committee Meeting.  Congratulations on a job well done!

Fairbanks people who came to testify at the Hearing were Dave Somers, Hank Bartos and myself.

To our newest Real Estate Commissioner, Stacy Risner!

• Stacy Risner, of Fairbanks, was appointed to the Real Estate Commission, which regulates and controls licensing, suspensions and revocations of Alaska’s real estate industry. Risner is an associate broker and director of operations for Madden Real Estate, and holds a seat for a broker or associate broker from Alaska’s Fourth Judicial District.

Electronic Signatures Signatures

I’ve heard that during Monday’s class 10/17/11 there was a debate as to the legitimacy or enforceability of electronic signatures on an Earnest Money agreement.  While I wasn’t there, and it’s not important to me who said what, we do want to clarify this issue. First, there is a State of Alaska “Uniform Electronic Transaction Act”  and it says that:

 ”A record or signature may not be denied legal effect or enforceability solely because it is in electronic form.”  
While both parties must agree to accept electronic signatures, that is taken into account on our EMRPA, where it says on Paragraph 8:
“Any facsimile transmission, electronic communication, or electronic signature of a signed copy of documents including any counter offers or addenda should be considered legally binding.”
Our clients must scratch this out or otherwise make it clear in the contract if they do not wish to accept electronic signatures.
So I wanted to clear this up, just to make sure this debate did not end up causing any harm to our clients, and therefore create liability to our membership.

RPAC Update: Fairbanks VS. Valley Board

In our ongoing struggle against the evil Valley Board of REALTORS, we are just $5389 behind the Valley Board, and the reason is that we have 41% member participation, and they have 79% member participation.  This is our last shot.  If you want to invest in RPAC, and you want it to count for this year, we need your contributions now!  Stay Tuned for our updated Office by Office competition as well.
